2. INSURANCE
Gesink – Turismo Náutico, Lda., has taken out an insurance cover amounting to EUR 500.000 per group. Should the contracting party consider this amount to be unsufficient, such party is advised to take out additional cover at its own costs.
3. CAPTAIN’S DECISIONS
a)Any and all decisions regarding navigation, destination and method of propulsion (sail and/or engine) are the solo responsibility of the Captain.
b)Only the Captain can decide, in view of the weather conditions, whether to sail or to return to the harbour. The Captain shall take such decision taking into account the age and composition of the group of passengers.
REMARKS:
I)No departure will take place in case of winds force 6 Beaufort or more. The Captain will return to harbour if the wind force increases to this level while sailing.
II)No departure will take place in case of waves being 3 meters high, or more. The Captain will return to harbour/pier if the wave’s heights increase to this level while sailing.
III)Above situations will not be considered as force majeure circumstances.
4. DRINKS AND MEALS
a)Drinks: Available on board at reasonable prices. Unless agreed upon at the time of booking, it is not allowed to bring one’s own beverages, whether alcoholics or not.
b)Meals: If so desired, Gesink – Turismo Náutico, Lda., will provide for catered meals at a cost to be agreed upon at the time of booking.
c)In case the client brings their own food and drinks there will be “cork fee” charged, with a value to be agreed upon at that time or afterwards.
5. BEHAVIOUR
a)Life-jackets: use of life-jackets is mandatory to all children up to the age of 10 years and to anyone else who doesn’t know how to swim.
b)Tabacco: It is forbidden to smoke in the toilets. Smoking is allowed on deck.
c)Garbage: Will have to be deposited in the containers on board, duly marked for the purpose. It is not allowed to throw any articles overboard.
d)Misbehaviour: In case of misbehaviour or ignoring orders from the crew, the captain is authorized to immediately terminate the trip and return to the harbour, to assure the safety of the passengers, the crew and the ship.
THESE CONDITIONS ARE SUBJECT TO PORTUGUESE LAW.
IN ALL CASES THAT CIRCUMSTANCES OCCUR THAT ARE NOT MENTIONED IN THESE TERMS, IT IS THE CAPTAINS SOLE RESPONSIBILITY TO TAKE DECISIONS TOWARDS THESE CIRCUMSTANCES.
